Greetings Civilian PBA Member,
Going forward, the PBA is required to retain PERC Form 2023-1.101 – Employee Organization Membership Authorization Form (“PERC Form”) on file at the PBA. Pursuant to Sec. 447.305(6), F.S., the PBA must not only maintain dues-paying membership of at least 60% of the civilian bargaining unit members, but also maintain the above-mentioned PERC Forms from its dues-paying members. If the PBA falls below the 60% threshold of dues-paying members, the civilian bargaining unit is at risk of losing its certification from the State of Florida. The PBA has already filed a recertification petition to ensure your bargaining unit/state certification remains intact with no lapse in coverage. However, we are having the forms signed prospectively to avoid filing a recertification petition in the future.
ALL portions of the PERC Form must be completed. The PBA can fill out the PERC Form; however, you will need to fill in your Name, Title, and Classification Code. Once completed, please sign, and date the PERC Form, and return it to the PBA or one of your PBA Representatives. Your completed PERC Form “must be delivered to the employee organization [PBA] identified on the form.” F.A.C. 60CC-1.101(6).
Of note for attorneys Larry Fagan and Katie Mendoza, each recovered attorney’s fees in the amount of $117,000.00 as the prevailing party in a contentiously litigated case which began in 2021 and ended in 2023. This one-time amount was included in their annual salary. Additionally, “Other direct or indirect disbursements” includes expenses for Board meetings, collective bargaining, recruitment, legislative initiatives, membership services/training (membership functions and publications), legal services, charity/fundraising, and other operating expenses (hall repairs/maintenance, insurance, office supplies, computer/IT).
